Privacy Policy & terms of Use

Effective Date: May 19, 2025

Privacy Policy

Thank you for visiting our website (toledocf.com). CrossFit Toledo is committed to protecting your privacy. This Privacy Policy explains what information we collect, how we use it, and how we safeguard it. By using our website, you consent to the data practices described in this policy.

1. Information We Collect

Personal Information You Provide

When you fill out forms on our site (such as contact forms, trial class sign-ups, or membership inquiries), we collect the personal information you choose to provide. This may include your name, email address, phone number, and any information you submit in messages. We use this information to respond to your inquiries, provide services, and communicate with you as requested.

Form Submissions and Email

Information you submit through web forms on our Squarespace-hosted site is transmitted to us and stored. Form submission data is forwarded to our designated email account (which is a Gmail address) for record-keeping and response. In other words, when you submit a form, the data is shared with our website platform (Squarespace) to deliver it to us, and a copy is stored in our Gmail inbox for follow-up. We do not sell or share the personal information you provide with third parties except as needed to operate our services or as required by law.

Automatically Collected Data (Analytics)

Our site uses Google Analytics 4 (GA4) to collect information about how visitors use the site. This includes data such as your IP address, browser type, device information, pages visited, the date/time of visits, and referring URLs. GA4 may use cookies and similar technologies to gather this usage data. We use this information in aggregate form to analyze website traffic, understand user behavior, and improve our website and marketing. Google Analytics 4 provides reports to us without identifying individual users by name. (See Googleโ€™s privacy policy for more details.) If you wish, you can opt-out of Google Analytics data collection by using Googleโ€™s browser add-on or adjusting ad settings.

Google Search Console

We use Google Search Console to monitor our websiteโ€™s presence in Google search results and to help us understand how people find our site. Search Console provides us with aggregated data about search queries, website traffic, and performance. It does not collect personal information from you directly, but it does tell us general information like which search terms led you to our site and any technical issues on the site. We use this information to improve our content and SEO. All data provided by Google Search Console is subject to Googleโ€™s privacy policies as well.

Cookies and Tracking Technologies

Our website uses cookies and similar technologies to ensure the site functions properly and to enhance your experience. For example, because our site is hosted on Squarespace, certain functional cookies are required for the site to operate and display correctly. These cookies may remember your preferences or enable features of the site. We also use analytics cookies (for services like GA4) to collect data on site traffic and user interactions (these are used only with your consent if required by applicable law). You may see a cookie consent banner on our site; if so, by clicking accept or continuing to use the site, you agree to our use of cookies. You can adjust your browser settings to refuse cookies or alert you when cookies are being sent. However, please note that some site features may not function properly if cookies are disabled. For more information on the cookies Squarespace uses to run this site, you can refer to Squarespaceโ€™s cookie policy documentation.

Site Hosting and Logs

This website is hosted on the Squarespace platform. As you use our site, Squarespace may automatically collect certain technical information in server logs to operate and secure the site. This can include data such as your IP address, browser type, device information, pages or files viewed, and the dates/times of access. Squarespace requires this data to run the website, protect the platform, and analyze performance. According to Squarespace, such data may be analyzed in a de-personalized or aggregated form. We do not personally extract or use this server log data except through the analytics tools mentioned above.

Third-Party Services (Wodify)

For class bookings, membership account creation, and payment processing, we utilize an embedded service called Wodify. If you choose to โ€œDrop Inโ€, sign up for a membership, or book classes through our site, you will be interacting with Wodifyโ€™s system (either via an embedded widget or a redirect to Wodifyโ€™s platform). Any personal information you enter for these purposes (such as creating a user profile or entering payment details) is collected directly by Wodify on our behalf. This may include personal identifiers and contact info (like name, email, phone, date of birth) required for setting up your membership, as well as billing information for payments. We do not store your payment (credit card/bank) details on our website or servers. Payment transactions and member account data are handled securely by Wodify in accordance with their own privacy policy and terms of service. We may have access to certain information from Wodify (for example, to see class registrations, your membership status, or contact info) in order to manage our gym operations, but that information resides in the Wodify system. Wodify is a third-party service, and any data you provide through their interface is subject to Wodifyโ€™s privacy and security practices. We encourage you to review Wodifyโ€™s Privacy Policy and Terms of Service to understand how they handle your data. In summary, when using Wodify features through our site, your data is shared with Wodify so they can process your account creation and payments.

2. How We Use Your Information

We use the collected information for purposes consistent with why you provided it and in accordance with applicable law. These uses include:

  • Providing Services and Responding to Inquiries: We use contact information (name, email, phone) that you submit to get in touch with you, answer questions youโ€™ve asked, provide the information you requested about our gym or programs, and facilitate the services you signed up for (such as scheduling a free introductory session or setting up a membership).

  • Membership and Class Management: If you become a member or register for classes, we (through Wodify) use your information to manage your membership, class reservations, billing, and related customer service. For example, we might use your email to send class reminders or your phone number to reach out regarding schedule changes, utilizing the tools provided by Wodify or our email system.

  • Improving Our Website and Services: We analyze aggregated data from Google Analytics 4 and other tools to understand how our website is used. This helps us identify trends (like which pages are most visited or where users come from) so that we can improve site content, navigation, and overall user experience. It also helps us refine our marketing strategies by understanding user interactions. Additionally, technical data collected by Squarespace (like device type or browser) may help us ensure the website displays correctly for all users and troubleshoot any performance issues.

  • Marketing and Communications: With your permission, we may use your contact information to send you newsletters, promotional emails about new classes or events, or other updates about CrossFit Toledo. (For example, if you sign up to receive our newsletter or indicate interest in promotions, we will use your email for that purpose.) You can always opt out of marketing emails โ€“ each such email will include an โ€œunsubscribeโ€ link to allow you to stop further messages. We do not inundate our members or visitors with marketing, and we do not share your contact information with outside marketers without your consent.

  • Safety and Legal Compliance: We may use or disclose personal information as necessary to enforce our websiteโ€™s Terms of Use or to protect the rights, property, or safety of CrossFit Toledo, our members, or others. For instance, if required by law or legal process (such as a court order, subpoena, or regulation), or to investigate/prevent suspected fraud, security issues, or violations of law, we might share relevant information with law enforcement or other authorities. Aside from such circumstances, we do not share your personal data with third parties for their independent use, except with service providers as described (e.g., Squarespace, Google, Wodify) or with your consent.

3. Data Security and Storage

We take reasonable measures to protect the security of your personal information. Our website uses secure HTTPS/SSL encryption for transmitting information you submit (you can notice the padlock or "https://" in the address bar, indicating an encrypted connection). Form submissions sent to our Gmail account are protected by Googleโ€™s security protocols. We keep our account credentials secure and utilize Googleโ€™s security features (such as two-factor authentication) to prevent unauthorized access to emails. The personal data handled through third-party services (Squarespace, Google Analytics, Wodify) is also protected by those services according to their security standards. For example, Wodify employs industry-standard security practices and encryption to safeguard personal and payment data, and any credit card transactions through Wodify comply with PCI-DSS security standards for payment processing. Squarespace, as our host, maintains security controls to protect its infrastructure and your data traversing it.

Despite all these precautions, please understand that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security. You share information at your own risk, but we will do our best to keep it safe and secure. We retain personal information only for as long as necessary to fulfill the purposes for which it was collected or to comply with legal obligations. For example, if you contact us with an inquiry, we may retain your correspondence for a period of time in case we need to reference it later, but we will not keep it longer than necessary. Membership records in Wodify are retained as long as you remain a member (and for a reasonable period thereafter for administrative purposes or as required by law). If you would like us to delete any personal information you have provided, you can contact us (see Contact section below) and, if feasible and not required otherwise by law or legitimate interests, we will honor such requests.

4. Childrenโ€™s Privacy and Minors

Our website and services are not directed to children under the age of 13, and we do not knowingly collect personal information from anyone under 13 years old. If you are under 13, do not use this site or submit any information. If we learn that we have inadvertently received personal data from a child under 13, we will delete it.

For minors between 13 and 17 years of age: While those under 18 may be interested in our CrossFit programs (for example, high school athletes or teens), a parent or legal guardianโ€™s consent and involvement are required for any minors to participate in our classes or provide personal information. If you are under 18, you should only use our site and services with the permission and supervision of your parent or guardian. Do not submit any personal information or sign up for classes on your own if you are under 18; instead, have your parent or guardian contact us or accompany you in the registration process. We require that a parent or guardian co-sign any gym membership agreement or liability waiver for participants who are minors. In summary, users under 18 must have parental approval and a parent/guardianโ€™s signature on all required documents before engaging in our programs.

5. Third-Party Websites and Links

Our website may contain links to external websites or services that are not operated by us. For example, we link to our social media pages (Instagram, Facebook, YouTube), and to external resources like Wodify for certain functions (class scheduling or membership management). If you follow a link to a third-party website, please be aware that those sites have their own privacy policies and terms of use. We do not have control over and are not responsible for the content, privacy practices, or behavior of external sites. Wodify, for instance, is a third-party platform we use; any information you provide through the Wodify interface is governed by Wodifyโ€™s policies, not this Privacy Policy. We encourage you to read the privacy policies of any third-party sites or services that you visit via links from our website so that you understand how they collect and use your information. Use of external sites is at your own risk, and we are not liable for any issues arising from your use of third-party websites.

6. Updates to This Privacy Policy

We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other reasons. When we make changes, we will update the "Effective Date" at the top of the Policy. Significant changes may be announced on our website or via email notification if appropriate. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information. Your continued use of the website after any changes to this Policy constitutes your acceptance of the updated terms.

By accessing or using our site, you acknowledge that you have read, understood, and agree to be bound by the following terms and conditions, as well as our Privacy Policy above. If you do not agree with these terms, please do not use our website.

Please read these Terms carefully. They include important disclaimers of liability (see Section 5) and a requirement that users under 18 have parental consent (see Section 4). We reserve the right to modify these Terms at any time as described in Section 6.

1. Acceptance of Terms and Use of the Site

By using our website, you confirm that you accept these Terms of Use and agree to comply with them. You are granted a limited, revocable license to access and make personal, non-commercial use of this site.

Permitted use: You may view, download, or print pages from this site for your own personal, informational use, for non-commercial purposes.

Prohibited use: Under this license, you may not:

  • Reproduce, duplicate, copy, sell, trade, or otherwise exploit our website or any portion of it for any commercial purpose without express written consent from CrossFit Toledo.

  • Modify, distribute, or create derivative works based on the siteโ€™s content. (This includes removing or altering any copyright, trademark, or other proprietary notices from copies of content.)

  • Use the site for any unlawful purpose or in any manner that could disable, overburden, damage, or impair the site or interfere with any other partyโ€™s use of the site.

  • Attempt to gain unauthorized access to any portion of the site, other accounts, computer systems, or networks connected to the site, through hacking, password mining, or any other means.

  • Use any automated system (such as robots, spiders, or offline readers) to access the site in a manner that sends more request messages to our servers than a human can reasonably produce in the same period by using a conventional browser.

  • Reverse engineer, decompile, or disassemble any software or technology used to provide the site or its features.

  • Use the site to post or transmit any harmful or disruptive content, including any malware, viruses, spam, or content that is defamatory, obscene, or invasive of privacy.

This license for site access shall automatically terminate if you violate any of these restrictions. If we determine (in our sole discretion) that you have breached any provision of these Terms, we may terminate your permission to use the site and deny you further access. Upon termination of this license, you must immediately discontinue use of our site and destroy any downloaded or printed materials from our site in your possession.

2. Intellectual Property and Trademarks

Unless otherwise indicated, all materials on the site โ€“ including text, graphics, logos, images, designs, compilations, and the organization of such materials โ€“ are owned by CrossFit Toledo or used with permission. This content is protected by copyright, trademark, and other intellectual property laws. You must not use any content from our site (other than as explicitly allowed under Section 1 for personal use) without our prior written permission.

โ€œCrossFit Toledoโ€ and our logos are trademarks or service marks owned by our organization. In addition, โ€œCrossFitโ€ is a registered trademark of CrossFit, LLC. All CrossFitยฎ-related marks, names, and logos used on this website are used with permission, under license from CrossFit, LLC. We acknowledge and respect the ownership of those marks by CrossFit, LLC. You are not permitted to use the CrossFit name or any of our trademarks or the trademarks of third parties featured on this site for your own purposes (for example, in advertising or marketing) without obtaining the relevant ownerโ€™s consent. Any unauthorized use of the content or trademarks on this site may violate copyright laws, trademark laws, the rights of privacy and publicity, and/or other regulations and statutes. We reserve all rights not expressly granted in these Terms.

3. Third-Party Services and Links

Our website integrates or links to certain third-party services to enhance user experience and provide certain functions:

  • Wodify (Membership and Payments): As noted in our Privacy Policy, class bookings, new account registrations, and payment processing are handled through Wodify, a third-party gym management platform. When you use these features (for example, clicking โ€œDrop In or Sign Upโ€ or viewing our class schedule), you may be interacting with content served by Wodify (such as embedded widgets or an iframe). Any account you create or transaction you complete via Wodify is governed by Wodifyโ€™s own Terms of Service and Privacy Policy. We provide these links for your reference: see Wodifyโ€™s Terms of Service and Privacy Policy for details. By using the Wodify features on our site, you agree that Wodifyโ€™s terms and policies apply to those interactions. CrossFit Toledo is not responsible for the operation or security of the Wodify platform, and we disclaim liability for any issues arising from your use of Wodify. However, if you have concerns or difficulties with sign-ups or payments through Wodify, you can contact us and we will assist in liaison with Wodify as needed. Please ensure you read Wodifyโ€™s policies, as they cover how your data is handled and your rights and responsibilities when using that service.

  • External Links: Our site contains links to other external websites and resources that are not operated by us, such as our social media pages (e.g., Instagram, Facebook) or partners (e.g., nutrition meal plan providers). These links are provided for convenience and informational purposes. We have no control over the content, policies, or practices of third-party sites. Therefore, we do not accept responsibility for any loss or damage that may arise from your use of them. When you click an external link, you will be subject to that third partyโ€™s terms and policies. We recommend reviewing the terms of use and privacy policies of any third-party websites you visit. Inclusion of any link on our site does not imply our endorsement of the external site or its content. Use external websites at your own risk.

  • Third-Party Content: Any testimonials, videos, or blogs on our site might occasionally include content or media hosted on third-party platforms (for example, embedded YouTube videos or Instagram feeds). Such content is subject to the terms of the respective third-party providers (YouTube, Instagram, etc.). We are not responsible for third-party contentโ€™s availability or accuracy. If you post comments or interact with our content on third-party platforms, be aware that you are also bound by those platformsโ€™ user agreements.

4. User Accounts, Eligibility, and Parental Consent

In general, you can browse our website without creating a user account. The only user accounts associated with our services are those for gym membership and class scheduling, which are created through the Wodify platform. If you register for an account via Wodify to manage your membership or class bookings, you are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account. Please use a strong password and do not share your account information with others. If you become aware of any unauthorized use of your Wodify account or any other breach of security, you must notify Wodify and/or CrossFit Toledo immediately.

Accuracy of Information: When creating an account or signing up for services (including free trial classes or drop-ins), you agree to provide true, accurate, current, and complete information about yourself. You also agree to update such information promptly if it changes. Providing false information or impersonating another person is a violation of these Terms and may result in termination of your access.

Age Requirement: You must be at least 18 years of age (or the age of majority in your jurisdiction) to purchase a membership or utilize the services of CrossFit Toledo on your own. Individuals under 18 are welcome to participate in certain classes or programs only with the involvement and consent of a parent or legal guardian. If you are under 18, a parent or guardian must consent to your use of our services, accompany you (or otherwise oversee your involvement) as required, and agree to these Terms on your behalf. We require a parent or guardianโ€™s signature on our standard liability waiver and any membership agreements for minors. By allowing a minor to use our site or services, the parent/guardian assumes full responsibility for the minorโ€™s use and compliance with these Terms. We reserve the right to refuse service, terminate accounts, or cancel reservations if we believe that the user is under 18 and does not have proper consent, or if any information provided indicates a violation of this requirement.

5. Disclaimers of Warranties

Use at Your Own Risk: Your use of the CrossFit Toledo website and our online services is at your sole risk. The site and all content on it are provided on an โ€œas isโ€ and โ€œas availableโ€ basis without any warranty of any kind, either express or implied. CrossFit Toledo makes no warranty or representation that the website will be uninterrupted, secure, or error-free, that any particular results can be obtained by use of the site, or that the content is accurate, complete, or up-to-date. We are constantly improving the siteโ€™s content, and it is possible that the site may contain typographical errors or inaccuracies. We do not warrant the reliability or validity of any data or information on the site. To the fullest extent permitted by law, CrossFit Toledo disclaims all warranties of any kind related to the site and its content, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We also do not guarantee that the site will be free from viruses, malware, or other harmful components, though we take reasonable measures to secure our site.

Fitness and Health Information: The content on our website (such as blog posts, workout tips, or class descriptions) is provided for general informational purposes. It is not intended as professional medical advice or a substitute for consultation with a healthcare provider. CrossFit training is a high-intensity fitness program that may not be suitable for everyone. Consult your physician or healthcare provider before starting any new exercise regimen, especially if you have any pre-existing medical conditions or injuries. CrossFit Toledo and its coaches are fitness professionals, but we are not medical doctors. Nothing on our site should be taken as medical advice. You assume all risk for your health and well-being when following any exercises or programs described on the site or when participating in our workouts.

Results Not Guaranteed: Any testimonials or success stories on the site are individual experiences and are not guarantees that you will achieve similar results. Fitness results vary from person to person depending on numerous factors. We make no promises or warranties that you will achieve any particular outcome from training at CrossFit Toledo.

6. Limitation of Liability

To the maximum extent allowed by applicable law, CrossFit Toledo (and its owners, coaches, employees, and agents) shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from your use of the website or our services. This includes, for example, damages for lost data, lost profits, or business interruption, or any damages for personal injuries or property damage arising out of or related to the use of our website or information, even if we have been advised of the possibility of such damages.

In particular, CrossFit Toledo will not be responsible for any injury, illness, or other health issue that may result from utilizing information on our site or from participating in our fitness programs. By using our site and/or participating in our classes, you agree to assume all inherent risks of CrossFit and exercise activities. All participants in our gym are required to sign a Release of Liability Waiver acknowledging these risks. This waiver is a separate agreement that covers fitness-related liability in detail (including, but not limited to, the risk of physical injury or death from strenuous activity). The terms of that waiver are incorporated by reference here: essentially, you agree that CrossFit Toledo and its coaches will not be held liable for injuries or damages that result from the ordinary negligence or accidental occurrences in the context of our training programs. We do not seek to limit liability for gross negligence or willful misconduct; however, by using the site and our services, you understand and agree that CrossFit training has inherent risks and you participate voluntarily, assuming all risks.

If, notwithstanding the above disclaimers, CrossFit Toledo is found liable to you for any claim or cause of action arising out of the use of this website or our services, our aggregate liability (together with our employees and agents) for all claims shall not exceed the amount (if any) you paid to us for the service in question, or if the claim arises from use of the free website, a nominal sum of $100. Some jurisdictions do not allow certain liability exclusions or limits; in such jurisdictions, our liability will be limited to the fullest extent permitted by law.

7. Indemnification

You agree to indemnify, defend, and hold harmless CrossFit Toledo, its owners, coaches, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneysโ€™ fees and legal costs) arising out of or in any way connected with:

  • your access to or use of our website or services;

  • your violation of any of these Terms of Use; or

  • any allegation that any content you provide to us (for example, if there were a feature allowing you to post comments or feedback) infringes or violates the intellectual property rights or other rights of any third party.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with us in such defense.

8. Modifications to Terms and Services

CrossFit Toledo may revise these Terms of Use for its website at any time. If we update the Terms, we will post the revised version on this page with a new effective date. It is your responsibility to review these Terms periodically for any changes. Your continued use of the site following the posting of changes constitutes acceptance of those changes. We may also update or discontinue certain features of the website at any time. We do not guarantee that any specific content, component, or feature of the site will always be available. We reserve the right to modify or remove any content on the site without notice, but we do not have an obligation to update any outdated information.

9. Governing Law and Jurisdiction

These Terms of Use and any disputes arising out of or relating to these Terms or your use of the website (including any non-contractual claims) shall be governed by and construed in accordance with the laws of the State of Ohio, USA, without regard to its conflict of law principles. By using the site, you agree that any legal action or proceeding between you and CrossFit Toledo shall be brought exclusively in the federal or state courts located in the State of Ohio. You consent to the personal jurisdiction of such courts and waive any objections (such as inconvenient forum) to the jurisdiction or venue of those courts. We operate this website from the United States, and we make no representations that the content or the site is appropriate or available for use in other locations. If you access the site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

10. Miscellaneous

If any provision of these Terms of Use is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be deemed severable from the remaining terms and will not affect the validity and enforceability of the remaining provisions. The remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of CrossFit Toledo. These Terms of Use, together with our Privacy Policy and any other legal notices or terms expressly incorporated herein, constitute the entire agreement between you and CrossFit Toledo regarding your use of the website. They supersede any prior agreements or communications between you and us concerning the subject matter of these Terms.
